Terms of service

These terms cover work carried out by Pixelith, a sole proprietorship operated by Marnu Mostert, based in South Africa. Engaging us means accepting them. Where a signed proposal says something different, the proposal wins.

What we do

We design, build and launch websites, and — on a monthly plan — host, monitor and improve them. Exactly what is included is set out on our pricing page and confirmed in writing before work starts.

What it costs

Prices are in United States dollars and exclude any tax that may apply. Larger builds — booking systems, e-commerce, multiple locations — are quoted separately after the audit.

What you pay for and when

The build is paid before launch. Monthly plans are billed monthly in advance and continue until cancelled. Work does not begin until the first payment clears.

What you provide

You supply your business information, any copy or images you want used, access to your domain, and timely feedback. You are responsible for buying and renewing the domain, and for the fees of any third-party service — hosting beyond our plans, CRM, booking systems, email — used in your project.

You confirm you have the right to use anything you send us. If a claim arises from material you supplied, it is yours to answer.

Timelines

A standard build takes as little as five working days. That clock starts when you have signed off the brief and supplied what we asked for, and pauses whenever we are waiting on you. We will tell you the date in writing before you commit; we will also tell you promptly if it moves.

Revisions

Launch includes one round of revisions after the first draft. Further changes are quoted, or covered by a monthly plan. Changes that alter the agreed scope are quoted before we do them, never after.

Who owns what

On final payment, the finished website is yours: the design, the code and the content we produced for you. The domain is registered in your name and stays yours regardless. We keep the right to reuse our own underlying methods, components and tooling, and to show the work in our portfolio unless you ask us in writing not to.

Monitoring, and what it means

On Basic and Pro we monitor uptime, errors and performance. We investigate and resolve issues within the scope of your plan and during reasonable hours. We do not promise that a site will never break, that a specific search ranking will be reached, or that any level of enquiries or bookings will follow. Anyone promising those things is guessing.

Cancelling

Monthly plans can be cancelled at any time with 30 days' notice, in writing. The site remains yours; we will hand over what is needed to move it elsewhere. Fees already paid are not refunded, and a cancelled plan ends hosting and monitoring at the end of the paid period.

We may end an engagement if payment is overdue, if we are unable to get what we need to proceed, or if we are asked to build something unlawful or dishonest.

Limits

We give no warranty beyond what these terms say. Our liability for any claim is limited to the fees you paid us in the twelve months before it arose. We are not liable for lost profit, lost business or indirect loss. Nothing here excludes liability that cannot lawfully be excluded.

Law

These terms are governed by the law of the Republic of South Africa, and disputes fall to its courts. We would much rather sort it out by email first.

Changes

We may update these terms; the date at the top will change. Work already agreed continues under the terms in force when it was agreed.
